Tigo Cash Terms & Conditions

1. The agreement

1.1.    You may use Tigo Cash services subject to the terms and conditions (“term”) in this agreement between you and us, Tigo Cash Ghana Limited. When you register for a Tigo Cash account (“account”), you agree to accept these terms.

2. Definitions

2.1.    “We” or “us” or “our” means Tigo Cash Ghana Limited an Electronic Money Issuer (EMI) as licensed by the Bank of Ghana and partner banks

2.2.    “You” or “your” means the Tigo Cash customer

3. Tigo Cash services

3.1.    Tigo Cash allows customers to send and receive money, buy airtime, pay bills, pay for goods and services from their mobile phone.

3.2.    Customers can deposit and withdraw money from their mobile phones through any of our authorized Tigo Cash agents.

3.3.    Customers are not required to hold a bank account to use the service

4. Service Providers

4.1.    Duly appointed service providers (also referred to as Tigo Cash agents) will provide the following service

4.1.1.    Register customers for the service

4.1.2.    Receive cash deposits from customers

4.1.3.    Allow cash withdrawals from customers

5. Registration for Tigo Cash

5.1.    Any Tigo customer with an active Tigo Ghana SIM card can register for a Tigo cash account

5.2.    Registration can take place with any Tigo cash agent or at a Tigo customer service center

5.3.    To register, a valid proof of identity (Voter ID, National ID, NHIS ID, Driver’s License, Passport or other acceptable proof of identity) is required

5.4.    The customer will be required to create a 4-digit secret code (“secret PIN”)

5.5.    Tigo Cash is limited to one account per customer

5.6.    We may decline your application at our sole discretion

6. Transacting

6.1.    Upon activation of your Tigo Cash account and once you have created value on your account, you will be able to carry out the following transactions:

6.1.1.    Deposit and withdraw cash at an authorized Tigo Cash agent

6.1.2.    Send money from your phone to another registered user of Tigo or any mobile customer

6.1.3.    Buy airtime for yourself or any Tigo customer from your phone

6.1.4.    Pay bills and pay for goods or services from your phone

6.2.    All transactions can be authorized by you with your secret PIN

6.3.    You are required to provide proof of identity to the agent for security purposes

6.4.    You must verify the accuracy of the information of your transaction before sending the command to confirm it.

6.5.    You will not be able to transact if you do not have enough funds in your account to cover the transaction amount and the applicable fees.

6.6.    You will receive a confirmation SMS after each successful transaction with your new account balance

6.7.    You can check your balance, request a mini-statement or change your secret PIN at any time

7. Fees

7.1.    For certain types of transactions, fees will be deducted from your account according to the amounts published in the user guide available from authorized Tigo Cash Agents, Tigo customer service centers, Tigo website and partner bank branches or by contacting our helpline on 100.

7.2.    We reserve the right to change the fee structure or the service if the need arises. You will be notified of such changes through advertisement, SMS, Tigo website and or other means.

8. Security and Unauthorized Use

8.1.    You are responsible for the safekeeping and proper use of your secret PIN for all transactions that take place on your account and you indemnify us against any claims made in respect of such transactions

8.2.    If at any time you believe that your SIM card or your secret PIN has been lost, stolen or compromised, you must report to our Helpline immediately at 100. We will block your account as soon as we reasonably can. Your account will be reinstated as soon as your identity has been established.

9. Closing your Account

9.1.    We will close your account on receiving a request from you.

9.2.    We may close your account, restrict activity or suspend access to your account if in any way we know or suspect your account is being used fraudulently, negligently or for illegal activities or if we must do so to comply with the law.

9.3.    We may block or close your account if we believe you are in breach of our terms, are trying to compromise our systems or are unreasonably interfering with any services provided by us.

9.4.    We may suspend or close your account and transfer any remaining funds to a holding account if your SIM becomes inactive or your Tigo number is reassigned to meet regulatory requirements or for any other reason.

9.5.    Upon closure of the account, you will be able to get access to your funds and repaid any sums in credit against your account by presenting in person to a Tigo customer service center with proof of identity.

9.6.    By closing the account, this agreement with us will be terminated.

10. Limitation of Liability

10.1.    We will not be responsible or liable for any direct, indirect, consequential or special damages arising from any act or omission by us, our service providers or any third party for whom we are responsible, whether arising in contract, delict or statue.

10.2.    We are not responsible for any loss arising from any failure, malfunction, delay or unavailability of the mobile network, mobile phone or internet resulting from circumstances beyond our reasonable control.

11. General

11.1.    The customer agrees that any registration information given to us is accurate, correct and up to date and if there are any changes, the customer will update us by visiting our customer service centers.

11.2.    We may use and disclose information of customers due to legal, audit, governmental or regulatory requirements; to prevent, detect or prosecute criminal or fraudulent activities; and to ensure the effective provision of Tigo Cash and Tigo mobile services.

11.3.    We may make changes to the terms from time to time. When these changes are made, we will make a new copy of the terms available at authorized Tigo Cash Agents, Tigo customer service centers, Tigo websites and or partner bank branches. The customer agrees that we will treat the continued use of the service as acceptance of the updated terms.

11.4.    We shall hold all funds received on the customer’s Tigo cash account on trust for the customer in bank accounts maintained by us in selected partner banks approved and licensed by the bank of Ghana. The customer shall be beneficially entitled to the amounts standing to the credit in the customer’s Tigo Cash account as conclusively evidenced in the records of the Tigo Cash system.

11.5.    The customer agrees that we shall not be obligated to invest the trust amounts other than by way of holding the same in the bank accounts and that the customer shall not have beneficial entitlement to any of the interest accrued on the amounts.

11.6.    This agreement is governed by the laws of the republic of Ghana.

11.7.    Any dispute arising from this agreement shall be referred to the High Court (Commercial Division) of Ghana.

12. Anti- Money Laundering & Counter Terrorism Financing (AML & CTF)

12.1.    You will not be involved or be an accomplice to money laundering and counter terrorism financing.

12.2.    You will report to Tigo any suspicious transaction noticed by calling Tigo Cash helpline 100.
